What's New?

We are busily getting ready for the upcoming Australia Human Resource Institute (AHRI) National Convention and Exhibition being held at the Brisbane Convention and Exhibition Centre 16 - 19 September 2019. 

This event welcomes HR professionals from all sectors, and provides a range of learning experiences and networking opportunities. It will be our 11th year attending, and we always look forward to providing attendees with the latest updates on matters impacting workplaces, in addition to discussing our services.  

Entry to the showroom floor is free, and we will be at stand 96 - make sure to stop by and say hello!

National Child Protection Week is coming up; 1 - 7 September 2019. This week is celebrated annually, and provides an opportunity for government, businesses, and the community to come together and promote the safety and wellbeing of children. 

2019's theme is 'child development', and a number of events are planned across Australia that you can get involved in. 

If you work with Children, or in a vulnerable sector, our short course 'Investigating Abuse in Care' addresses the needs of investigators who are tasked with managing or investigating reportable conduct matters. In The News

This month marks the one-year anniversary of the Workplace Advice Service, a free legal assistance program coordinated by the Fair Work Commission. The service is offered by the Commission as part of its on going efforts to import access to justice, and reduce complexity for unrepresented individuals or small business employers.

public servant's decision to accept a voluntary redundancy has undone her bid to establish that the Australian Financial Security Authority (AFSA) bullied her and retaliated against her whistleblowing by transferring her to its HR department. 

In her FWC claim to 'stop bullying', the public servant alleged that AFSA had transferred her from finance to HR, because she made public interest disclosures about procurement breaches.

By the time of this decision, the public servant had accepted an offer of voluntary redundancy. 

Deputy President John Kovacic threw out the case, saying the tribunal had repeatedly tried to contact the public servant between June and mid-July 2019 to ask whether she would discontinue her application. He said the public servant failed to respond or make further contact with the tribunal. 

Likewise, in 'circumstances where they are no longer employed', Deputy President Kovacic said he did 'not consider that there was a risk that she will continue to be bullied at work'.

The Fair Work Ombudsman has commenced legal action in the Federal Circuit Court against WA labour-hire business, Corporation Sun Pty Lt, and its Chief Executive.

The Ombudsman alleges that the company breached the Fair Work Act, by failing to comply with a Compliance Notice, requiring the company to back-pay $20,011 to 11 underpaid workers. 

After receiving a number of requests for assistance from workers, Corporation Sun was issued a notice requiring the business to rectify the alleged underpayments. 

The FWO is also seeking a Court Order requiring the company to rectify the underpayments in full. A directions hearing has been listed in the Federal Circuit Court in Perth for 16 September 2019. 

The FWO is cracking down on the alleged underpayment of vulnerable workers, and Ombudsman Sandra Parker has stated they will continue to audit businesses and utilise the full suite of enforcement tools to hold employers to account.
